These Terms of Service (“Terms”) govern your access to and use of the Callgent website, applications, and AI voice receptionist services (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Use of the Services

You must be at least 18 years old and authorized to bind the business you represent. You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations. You are responsible for all activity under your account.

Accounts and subscriptions

Some features require an account and paid subscription. You agree to provide accurate information and keep it up to date. Subscription fees are billed in advance according to your selected plan. You may cancel at any time; cancellation takes effect at the end of the current billing period.

Acceptable use

You agree not to use the Services to:

• Violate any law or regulation
• Infringe intellectual property or privacy rights
• Send unsolicited or fraudulent communications
• Interfere with or disrupt the Services or third-party systems
• Reverse engineer, scrape, or abuse the Services

Content and data

You retain ownership of the content and data you provide. By using the Services, you grant us a limited license to use that content solely to operate and improve the Services. We will handle your data in accordance with our Privacy Policy.

Telecommunications and recording

You are responsible for complying with all laws related to phone calls, recordings, and artificial voice disclosures, including obtaining any required consent from callers. Callgent provides tools to help you comply, but compliance is your responsibility.

Intellectual property

Callgent and its licensors own all rights in the Services, including software, trademarks, and branding. These Terms do not grant you any right to use our trademarks or other intellectual property except as necessary to use the Services.

Limitation of liability

To the fullest extent permitted by law, Callgent is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising out of your use of the Services.

Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or if required by law. Upon termination, your right to use the Services immediately ceases, but provisions related to liability, intellectual property, and dispute resolution will survive.

Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page with an updated effective date. Your continued use of the Services after changes means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in Delaware.
